Acquisition Opportunity: Assets of Delta Biofuel UCC Article 9 Foreclosure
Hilco Global presents the opportunity to acquire the assets of Delta Biofuel, a renewable and sustainable energy solutions-based platform driven by converting processed sugarcane byproduct into a pelletized renewable energy source.
An asset sale will be conducted pursuant to Article 9 of the Uniform Commercial Code on behalf of the secured lender (the “Secured Party”). The assets will be offered and sold by the Secured Party on an “as-is” “where-is” basis without representations or warranties of any kind. Potential bidders are encouraged to conduct their own diligence with respect to any and all information provided herein regarding the assets. Any information regarding the operations and financial performance of Delta Biofuel has not been separately verified by the Secured Party.

Bagasse, the residual waste from sugarcane, presents a significant environmental challenge for sugar growers and contributes to climate issues. When bagasse is left to
decompose in large quantities, it emits methane, a potent greenhouse gas.
To address this problem, Delta Biofuel is actively converting this liability into a sustainable energy and carbon sequestration solution. The company’s inaugural facility in Jeanerette, Louisiana converts sugarcane bagasse into uniform biomass pellets through an integrated, industrial scale production process—from receiving and washing through drying, pelletizing, and loadout. The facility benefits from proprietary pelletization technology and is designed to produce biomass pellets for industrial and energy markets.
A bagasse pellet mill is comprised of machinery specifically designed to process bagasse into pellets. Bagasse is a byproduct of sugarcane processing and is rich in fiber. The pelletization process involves compressing the bagasse fibers into small, uniform-sized pellets, which can then be used as a renewable energy source.
Delta Biofuel’s production process converts wet, ash-bearing sugarcane bagasse into dry, dense, uniform biomass pellets through five primary stages.
The asset package includes all of Delta Biofuel’s right, title, and interest in all of its personal property, equipment, fixtures, intellectual property, accounts receivable, inventory, and all other collateral as described under the loan documents between the company and the Secured Party. The real property underlying the facility is not a part of the asset package. A virtual data room containing additional diligence materials regarding the business and the assets are available to parties under NDA.
The assets are being offered at a Secured Party public auction sale pursuant to Article 9 of the Uniform Commercial Code. The assets will be sold free and clear of the Secured Party’s lien and any subordinate security interests in the assets. The assets are being sold without recourse to the Secured Party and its attorneys, agents, or representatives on an “as-is” “where-is” basis without representations or warranties of any kind. The Secured Party does not claim title to the assets being foreclosed upon and sold hereunder and disclaims any warranty of title, possession, and the like in the sale. The Secured Party reserves the right to credit bid all or a portion of its secured indebtedness at the public auction.
